Terms of Service

0. Definitions

• mediX — the health management application and related services.
• User — a natural person who has created an account and uses mediX.
• Health Data — data entered by the User (weight, nutrition, medications, mood, physical activity, etc.) which constitutes special category personal data under the GDPR.

1. Service Description

mediX is a free health management application that enables:

• Medication search and price comparison across Estonian pharmacies
• Drug interaction checking
• Nutrition tracking and calorie counting
• Body weight tracking
• Mood and mental health tracking
• Physical activity tracking

2. Account Creation and Registration

An account is required for full use of the application. By creating an account, you agree and confirm that:

• You are at least 13 years old. Individuals under 13 may only use mediX with the consent and supervision of a parent or legal guardian.
• You provide truthful and accurate information (including a valid email address and your name).
• You create a secure password (at least 8 characters, including at least one uppercase letter and one number).
• You will not create multiple accounts or use another person’s account.

You are responsible for maintaining the security of your account. If you suspect unauthorized access, you must notify us immediately at medix@probyte.ee.

3. Medical Disclaimer

mediX is not a medical device and does not replace the advice of a doctor, pharmacist, or other healthcare professional.

• All information provided in the application is general in nature and does not constitute individual medical advice.
• Drug interaction checking is merely an aid and does not replace professional medical assessment.
• Before taking medications, changing dosages, or starting or stopping treatment, you must consult a doctor.
• In case of emergency, call 112.

4. License Grant

By accepting these Terms of Service, mediX grants you a personal, non-commercial, non-transferable, and revocable license to use the application solely for your personal purposes. All rights not expressly granted herein are reserved by mediX.

5. User Data and Health Data

You are the owner of all data you enter into mediX. By entering data, you grant mediX a free, worldwide, non-transferable license to process such data to the extent necessary for providing the service (including displaying, calculating, and storing data).

You are responsible for ensuring that the data you enter is truthful and does not infringe the rights of third parties.

6. Data Processing and Privacy

All personal data, including sensitive health data, is processed in accordance with the European Union General Data Protection Regulation (GDPR).

You agree that we process your data solely for the purpose of providing the service. We do not sell, share, or use your data for advertising or profiling. Data is not transferred outside the European Union / EEA.

Security

• Data is encrypted and stored on secure servers in the European Union.
• Passwords are protected with the bcrypt algorithm.
• SSL/TLS connection and other standard security measures are used.

Your Rights

You have the right to access your data, rectify it, delete it, restrict processing, and request data portability. To delete your account and all data, contact medix@probyte.ee. Data will be deleted within 30 days (except where legal retention obligations apply).

7. Third-Party Services

• Medication prices and information are sourced from public data at raviminfo.ee. mediX is not responsible for the accuracy or timeliness of this data.
• If the application uses third-party services in the future (e.g., Apple Health, Google Fit), their terms of service and privacy policies will also apply.

8. User Obligations and Prohibited Activities

By using mediX, you agree to:

• Not use the service for illegal or harmful purposes
• Not test, attack, or attempt to bypass the application’s security systems
• Not use automated tools (including scraping, bots)
• Not enter false data or harmful content
• Not share your account with other persons

9. Intellectual Property

All mediX content, design, logo, software, and databases belong to mediX. You may not copy, distribute, modify, or use them without prior written permission.

10. Service Availability

The service is provided on an “as is” basis. mediX does not guarantee that the service will always be available, uninterrupted, or error-free. We reserve the right to temporarily suspend the service for maintenance, updates, or security work.

11. Limitation of Liability

mediX shall not be liable for damages arising from the use or non-use of mediX, including:

• Decisions based on general information presented in the application
• Inaccuracy of third-party data
• Loss or damage of data due to force majeure

Liability is limited to the maximum extent permitted by the laws of the Republic of Estonia.

12. Changes to Terms

mediX reserves the right to modify these terms. In case of significant changes, we will notify you by email or through the application. Continued use of the service after changes constitutes acceptance of the modified terms.

13. Account Closure

• You may request account closure at any time by emailing medix@probyte.ee.
• Data will be deleted within 30 days.
• mediX reserves the right to close an account if the user violates these terms.

14. Governing Law and Dispute Resolution

These terms are governed by the laws of the Republic of Estonia. Disputes shall be resolved in Harju County Court.
